Benjamin Libet compared the perceived time of direct brain stimulation to the perceived time of skin stimulation. His results are among the most controversial experiments at the interface between psychology and philosophy. The new element that I bring to this discussion is a reanalysis of Libet's raw data. Libet's original data were difficult to interpret because of the manner in which they were presented in tables. Plotting the data as psychometric functions shows that the observers have great uncertainty about the (...) relative timing of events, as seen the shallow psychometric slopes. A second indication of uncertainty comes from Libet's use of three response categories, A first; B first; and A and B simultaneous. The large number of “perceptually simultaneous” responses provides a further measure of the difficulty of the judgment. There are thus a very broad range of stimulus delays in which the subject is unable to make an accurate ordering response. These points provide evidence that there is no compelling reason to invent exotic or ad hoc mechanisms to account for Libet's data since the uncertainty window is large enough to allow simple mechanism such as memory shifts. Libet argued that his data provide evidence for a backward referral in time. I argue that even though Libet's own data are weak, there are good arguments for a backward referral mechanism to help the subject make sense out of the tangled chaos of asynchronous information associated with experienced events. There have been two principal paradigms for the formulation of the causal relation--logical implication and functional relationship. In this paper, I present a case for preferring the functional relationship formulation and then discuss how the functional relationship formulation may be implemented in the probabilistic case in a manner analogous to the way others have implemented the logical implication formulation in the probabilistic case. I show how the "local independence" assumption found in many models used in the behavioral and social sciences (...) is a consequence of the functional relation concept of probabilistic causality. I also discuss why causal relations are underdetermined in experience and are to be dealt with pragmatically in a hypothesis-testing framework. (shrink)

Model simplicity in curve fitting is the fewness of parameters estimated. I use a vector model of least squares estimation to show that degrees of freedom, the difference between the number of observed parameters fit by the model and the number of explanatory parameters estimated, are the number of potential dimensions in which data are free to differ from a model and indicate the disconfirmability of the model. Though often thought to control for parameter estimation, the AIC and similar indices (...) do not do so for all model applications, while goodness of fit indices like chi-square, which explicitly take into account degrees of freedom, do. Hypothesis testing with prespecified values for parameters is based on a metaphoric regulative subject/object schema taken from object perception and has as its goal the accumulation of objective knowledge. The process of arrest in federally funded technology is illuminated through the case of weather modification. A technology passes through three stages: birth, opportunity, and decline. Critical to arrest is failure by the advocacy coalition to make maximum use of the opportunity stage to show progress and build support. To do so may require unusual cohesion and consensus among diverse advocates: scientists, administrators, politicians, industry, and affected publics. Without such consensus, opportunity is missed or misused, and a technology moves into (...) decline. This happens because the advocacy coalition shrinks and government support, essential to advance, diminishes and may even terminate. (shrink)

Exploratory statistics represents the transformation of a realist theory of statistics held by early nineteenth-century astronomers into an empiricist theory of statistics held by biometricians at the turn of the twentieth century. This paper discusses four key ideas in empiricist thought that influenced the form exploratory statistics took: (1) Baconianism, (2) associationism, (3) the search for cognitive calculi, and (4) phenomenalism. Some limitations of and alternatives to exploratory statistics as a hypothesis-generating methodology are discussed.

This paper utilizes the theories of metaphor of George Lakoff, Mark Johnson and Julian Jaynes to extend Jaynes' metaphor theory of consciousness by treating consciousness as an operator that works with 'covert behavior' so that humans can integrate temporally discontinuous percepts with concepts based on metaphoric extensions of the embodied schemas of direct and immediate perception and thereby transcend the limitations of direct perception. A theory of first-person expressions and covert behavior to account for self-conscious awareness as language-based is advanced. (...) Until recently, with one historical exception, America was able to take for granted a coherent national culture and identity. Successive waves of immigrants entered a country that assumed that their ultimate assimilation was a desirable, not an oppressive, outcome. The United States did not prove equally hospitable to everyone: some groups endured enormous hardships on their way to a fuller realization of America's great promise of opportunity and freedom. Yet, throughout U.S. history, the dream of common purpose and community propelled (...) the collective desire to live up to this promise and provided the framework within which progress was understood and made. This essay has been by necessity a gloss of a complex look at the relations of power, control, and personal identity construction in a workplace. Features of the nature of the work process combine with social strategies to construct a reproductive self-referential system. Corporate organizations are central institutions in contemporary life; they make developmental decisions for individuals and for society as a whole. While they are in this sense political to the core, we have not done enough to understand how (...) this politics works or to explore its relation to people in a democratic society. Using a phenomenologically-based communication analysis enables a sensitive analysis of the multiple forms of power and domination as they exist in corporate sites. Although I have given only an outline of one case study here, this example suggests that phenomenologically-based projects can show harmful and unwarranted control, and can be a first step to fostering corporate practices that lead to decisions which are less wasteful of resources and more fully accomplish the goals of democratic society. BackgroundThe terminal illness of late-stage Alzheimer’s and related dementias is progressively cruel, burdensome, and can last years if caregivers assist oral feeding and hydrating. Options to avoid prolonged dying are limited since advanced dementia patients cannot qualify for Medical Aid in Dying. Physicians and judges can insist on clear and convincing evidence that the patient wants to die—which many advance directives cannot provide. Proxies/agents’ substituted judgment may not be concordant with patients’ requests. While advance directives can be patients’ last resort (...) to attain a peaceful and timely dying consistent with their lifelong values, success depends on their being effective and acceptable. A single flaw can provide opponents justification to refuse the directive’s requests to cease assisted feeding.AimThis article considers 24 common advance directive flaws in four categories. Process flaws focus on how patients express their end-of-life wishes. Content flaws reflect drafters’ selection of conditions and interventions, and how they are described. Inherent flaws can make advance directives unacceptable to authorities concerned about premature dying. Strategies are needed to compel physicians to write needed orders and to prevent third parties from sabotaging these orders after they are implemented. The article includes excerpts from “dementia-specific” directives or supplements that exemplify each flaw—mostly from the US and Europe. No directive critiqued here included an effective strategy to resolve this long-debated bioethical conflict: the past directive requests “Cease assisted feeding” but the incapacitated patient apparently expresses the desire to “Continue assisted feeding.” Some opponents to the controversial request, cease assisted feeding, use this conflict as a conceptual wedge to practice hard paternalism. This article proposes a protocol to prevent this conflict from emerging. These strategies may prevent authorities from requiring patients to fulfill authorities’ additional clinical criteria as a prerequisite to honor the requests in patients directives.ConclusionThis critique of flaws may serve as a guide to drafting and to selecting effective and acceptable advance directives for dementia. It also poses several bioethical and clinical questions to those in authority: Does your paternalistic refusal to honor patients’ wishes respect their self-determination? Protect vulnerable patients from harm? Force patients to endure prolonged suffering? Violate the principles of bioethics? Violate the very foundation of patient-centered care? (shrink)

An attention shift from a stationary to a changing object has to occur in feature space, in order to bind these stimuli into a unitary percept. This time-consuming shift leads to the perception of a changing stimulus further ahead along its trajectory. This attentional framework is able to accommodate the flash-lag effect in its multiple empirical manifestations.

Developing an intellectualist account of skill, Stanley and Williamson define skill as a kind of disposition to action-guiding knowledge. The present paper challenges their definition of skill. While we don’t dispute that skill may consist of a cognitive, a dispositional, and an action-guiding component, we argue that Stanley and Williamson’s account of each component is problematic. In the first section, we argue, against Stanley and Williamson, that the cognitive component of skill is not a case of propositional (...) knowledge-wh, which is typically indexical. In the second section, we seek to show that Stanley and Williamson face difficulties in arguing for a generic claim about skill as a kind of disposition, and they fail to defend intellectualism about skill based on the dispositional account. In the third section we argue that Stanley and Williamson need a more detailed account of the action-guiding aspect of skill to avoid several difficulties, including a threat of a regress. We close with some lessons for the debate over intellectualism and anti-intellectualism about skill. (shrink)

OBJECTIVE: To investigate whether eligibility criteria that exclude the elderly, persons with psychiatric disease, and persons with substance abuse problems from participation in randomized controlled trials (RCTs) are subjective and hence a source of variability in enrolment decisions and investigator uncertainty. DESIGN: Survey questionnaire. PARTICIPANTS: Cancer investigators from the United States and Canada. INTERVENTIONS: Investigators were presented with clinical vignettes from 3 patient categories--eligible, ineligible and uncertain--for each of 5 eligibility criteria--3 subjective and 2 objective--and were asked whether they would (...) enrol the patient in a trial and how sure they were of this decision. Demographic characteristics of the investigators were also collected. OUTCOME MEASURES: The difference in enrolment decisions between subjective and objective criteria, and the difference in the certainty associated with these decisions. RESULTS: Of 365 questionnaires sent out, 224 usable ones were returned. Compared with the objective criteria, the subjective criteria were associated with more variable enrolment decisions (p = 0.07 for the "eligible" scenario and p = 0.0001 for the "ineligible" and "uncertain" scenarios), and investigators were less sure about the decisions they made (p = 0.0001 for all scenarios). Demographic characteristics of the investigators failed to explain the observed differences. CONCLUSIONS: Subjective eligibility criteria may interfere with the conduct and interpretation of RCTs and, therefore, their use ought to be justified explicitly in the study protocol. RCT designers, funding agencies and research ethics boards have an important role in reviewing eligibility criteria for their necessity. (shrink)

In the spirit of William James, we present a process view of human consciousness. Our approach, however, follows upon Charles Tart’s original systems theory analysis of states of consciousness, although it differs in its reliance on the modern sciences of complexity, especially dynamical systems theory and its emphasis on process and evolution. We argue that consciousness experience is constructive in the sense that it is the result of ongoing self-organizing and self-creating processes in the mind and body. These processes follow (...) a broad developmental agenda already described by psychologists such as Jean Piaget. Similar constructive transformations of consciousness appear to have occurred across the course of human history. In this sense, phylogeny indeed recapitulates ontogeny. Finally, modern developmental research suggests that the most advanced levels of human growth transform consciousness in the direction of increasing selflessness and spirituality, rather than simply toward greater intelligence. Diderot's Supplement to the Voyage of Bougainville has often been read as a Rousseauian condemnation of modern civilization judged against the standard of pure Nature. A cursory reading of the Supplement does appear to present Tahiti as a natural utopia and Europe as a civilized prison. This essay rejects such a reading by demonstrating that the Supplement actually undermines any clear opposition between virtuous nature, represented by Tahiti, and corrupt civilization, represented by Europe. Although Diderot truly does offer a stinging (...) critique of modern Europe, he refuses to offer "nature" as a redemptive alternative. Instead, the Supplement offers an implicit critique of the politics of moralism. (shrink)

„O pełnej znajomości prawa można mówić tylko wówczas, gdy zna się prawo i wytworzone przez praktykę reguły posługiwania się nim” – pisał swego czasu Marek Zirk-Sadowski. Pogląd ten wiąże się z niezwykle istotnym sporem o kryterium poprawności dokonywanej przez sędziów wykładni prawa. Zlokalizowanie takiego kryterium wydaje się być szczególnie ważne choćby ze względu na zawartą w naszym systemie prawnym konieczność realizowania zasady trójpodziału władzy, zgodnie z którą w procesie stosowania prawa nie może dochodzić do tzw. kryptoprawotwórstwa. Celem niniejszego tekstu jest (...) zaprezentowanie wybranych koncepcji poprawności wykładni prawa oraz ich krytyka w świetle neopragmatyzmu Stanley'a Fisha, filozofa prawa oraz profesora literaturoznawstwa, którego głównym przedmiotem refleksji był problem interpretacji. Filozofia amerykańskiego neopragmatysty opiera się na dwóch koncepcjach: reader-response criticism i wspólnotach interpretacyjnych. Reader-response criticism polega na skupieniu się na afektywnym aspekcie procesu interpretacji, uznając czytelnika za kluczową instancję tego procesu; koncepcja wspólnot interpretacyjnych z kolei ma wytłumaczyć, dlaczego podmiot interpretuje w taki a nie inny sposób. Zaproponowana przez Fisha metoda pozwala uznać, że de facto jedynym możliwym kryterium poprawności wykładni są inne decyzje sędziowskie. W świetle powyższych uwag wydaje się zasadnym stwierdzenie, że podejście Fisha umożliwia pogłębienie refleksji na temat jednej z kluczowych kwestii zarówno dla praktyki jak i teorii prawniczej, tj. poprawności wykładni prawa. Establishing a link between phenomenology and hermeneutics as seen by philosophers and as applied by students of religion is the pioneering aim of this book. No existing book ties together the cross-disciplinary strands in a way that is useful for religious studies. A phenomenological and therefore hermeneutical approach to religion "prides itself on being aware of its own presuppositions and those of others that are brought to bear on data to be interpreted." Thus it "seeks to gain an access to (...) the religious worlds of other peoples in as pure a form as possible." Phenomenological hermeneutics differs from the traditional comparative study of religion in an important way: the new method attempts an empathic understanding of religious experiences before making any comparisons or drawing any inferences. Part I shows how the phenomenological approach must arise from a "crisis of doubt within the prevailing tradition." It goes on to compare this approach to the mystics' understanding of the "scope and limitations of rational consciousness," contrasting it with the nominalists' dichotomy between faith and reason. Part II starts with Eliade's "creative hermeneutics," which holds that an object or an act becomes real only insofar as it imitates or repeats an archetype, particularly the archetype of the sacred. It goes on to develop Cassirer's point that "myth is a particular way of seeing." Part Ill starts by showing how art, like religion, is an "imitation of an archetype." It goes on to apply hermeneutical phenomenology to the interpretation of ritual. "Ritual gesture," Chapter 6 argues, "thematizes the world," establishing a mystical symbolic relationship between body and world, the seen and the unseen. Part Ill continues with a critique of the writings of Carlos Castaneda, arguing that these contain "the symbolic elements of both archaic shamanism and classical mysticism." The final chapter treats the "three-tiered cosmos" that is universal in folklore: the tier of family-home-land-artifacts, the tier of clan-tribe-nation, and the tier of weather-seasons-natural forces, Each tier has its loric power, and these powers are united by shamans and mystics in one sacred "kingdom of power.". The intercellular junctions connecting the cytoplasms of fibre cells in the mammalian lens have until recently been regarded as a class of junction which is fundamentally different from that of the gap junctions in other organs. Recent observations, however, suggest that the lens junctions fit protein topology predictions common for all gap junctions. While the homologous peptide portions are predicted to form the channels, the divergent peptide portions of the gap junction polypeptides may adapt channel activity to the special tissue (...) requirements.
